BLOMSTEIN represents Fastned in preliminary reference proceedings before the ECJ

BLOMSTEIN represents Fastned in review proceedings concerning the award of contracts for the construction, maintenance and operation of fast charging stations at serviced rest stops on the German federal highways. The contract had been awarded to companies of the Tank & Rast Group by the Autobahn GmbH of the German Government without conducting a competitive public procurement procedure.

Fastned has been working intensively for many years to promote the expansion of charging infrastructures for electric vehicles in Germany. With the present review proceedings, the company wants to ensure that competition for the best solutions is also made possible at serviced rest stops. As the legal dispute raises questions of EU law in connection with the extension of concessions under public procurement law, the Düsseldorf Higher Regional Court has suspended it and referred it to the ECJ for a preliminary ruling (see here).
