Monitoring
We regularly act as Monitoring Trustees for authorities and companies in proceedings that often take several years. Monitoring Trustees are appointed by the European Commission and national competition authorities as well as by the Worldbank and other multilateral investment banks (“MDBs”, such as the African Development Bank Group, Asian Development Bank, European Bank for Reconstruction and Development, Inter-American Development Bank) as independent bodies to monitor a company’s compliance. In the antitrust context, this typically concerns compliance with commitments in merger control, state aid or abuse proceedings. Vis-à-vis MDBs, trustee mandates are typically aimed at assessing whether the compliance system of blacklisted companies is in line with the bank’s standards.
